Terms of Use (End-User Licence Agreement) — Think'It Gallery

These terms are an agreement between you and Richard van Wyk, an individual developer in Namibia ("we", "us"), for the Think'It Gallery app ("the App"), including its direct-download (APK) and Google Play versions.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on Android devices you own or control, for personal or internal business purposes. You may not resell, sublicense, reverse-engineer (except as permitted by law or by open-source licences of included components), or use the App to break the law.

If you obtained the App from Google Play, the Google Play Terms of Service also apply. If these terms conflict with mandatory consumer law where you live, that law wins.

2. Your content

Your photos, videos, audio and documents remain yours. The App works on them on your device at your instruction. You are responsible for having the rights to the content you edit, share, or set as wallpaper.

3. Editing, replacing and deleting files

"Save as copy" creates a new file. "Save (replace original)" overwrites the original after you confirm; the App keeps the original in a private "Recently replaced" area for 24 hours so you can restore it, after which it is permanently deleted.
Deleting files uses Android's system flow; on Android 11+ deleted items may go to the system trash.
Keep backups of important files. Phones fail, and storage can be lost.

4. AI features

All AI features run entirely on your device; the App uses no cloud AI. They are: search by description and voice search, transcripts, reading text in photos, cut-outs and People (face grouping you name yourself). Each uses an open model you choose to download (for example EmbeddingGemma for search, Whisper for transcripts, PP-OCRv5 for text); the App works without them. Editing (crop, adjust, trim) is manual. Results are automated suggestions and may be incomplete or wrong. Use of the model is also subject to the Gemma Prohibited Use Policy.

5. Price

On Google Play the App is a one-time purchase (the price is shown on Google Play before you buy; refunds follow Google Play's refund policy). It has no in-app purchases, subscriptions or advertising. If we ever offer optional paid features in future, they will be clearly marked, will need your separate agreement, and these terms will be updated first.

6. Updates

We may update the App to fix problems or add features. The direct-download version can check for updates; the Google Play version is updated through Google Play.

7. Open-source components

The App includes open-source software listed in Settings › About › Licences. Those licences govern those components and nothing in these terms limits your rights under them.

8. Disclaimer

To the maximum extent permitted by law, the App is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Nothing here excludes rights you have under consumer-protection law that cannot be excluded.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, arising from your use of the App. Our total liability is limited to the greater of NAD 100 or the amount (if any) you paid us in the 12 months before the claim. This does not limit liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.

10. Ending

You can stop using the App at any time by uninstalling it. We may end this licence if you materially breach these terms.

11. Governing law

These terms are governed by the laws of the Republic of Namibia. Courts in Windhoek have jurisdiction, without depriving consumers of the protection of mandatory laws, or the right to bring claims in the courts, of their country of residence.
